Terms of service

Agreement

By creating an account or using CalcFunnel (“the service”), you agree to these terms. If you use the service for a company, you confirm you can bind that company, and “you” means the company.

The service

CalcFunnel provides embeddable calculators, a customizer, lead capture, a CRM, webhooks and related features. We may improve, change or retire features. We’ll give reasonable notice before removing something material to paid plans.

Accounts

Keep your credentials secure and enable two-factor authentication. You’re responsible for activity in your account and for the people you invite to it. Tell us promptly about unauthorized access.

Plans, trials and billing

• Free plan limits are shown on the pricing page.
• Trials of paid plans last for the period shown at sign-up. Some trials require a payment method; if you don’t cancel before the trial ends, the paid plan starts.
• Subscriptions (monthly or yearly) renew automatically until cancelled. Prices exclude any applicable taxes.
• Lifetime plans are a one-time payment for continued access to that plan’s features for as long as we operate the service, subject to these terms and fair use.
• We may change prices for future billing periods with at least 30 days’ notice.
• Refunds are covered in our refund policy.

Acceptable use

You won’t: use the service for unlawful, deceptive or discriminatory purposes; send unsolicited communications without the consent the law requires; collect data you’re not permitted to collect; attempt to breach security or overload the service; reverse engineer it except where the law allows; or resell access except as part of your own services to clients (agencies may deliver calculators to their clients).

Your content and your leads

You own the content you create and the leads your calculators capture. You give us permission to host, process and transmit it to provide the service. You’re responsible for:

• having a lawful basis and any consents needed to collect and use lead information, including for calls and texts;
• the disclosures, disclaimers, licensing information and privacy notices on your websites; and
• the destinations you send data to via webhooks.

Calculators are estimates

Calculator results are estimates for illustration. They are not financial, tax, legal or lending advice, and they are not offers of credit. Statutory figures are sourced and dated but can change; you’re responsible for reviewing how calculators are presented on your sites.

Intellectual property

The service, calculators, templates and CalcFunnel brand are ours or our licensors’. Your plan gives you a limited, non-exclusive, non-transferable right to use and embed calculators while your account is in good standing.

Suspension and termination

You can close your account at any time. We may suspend or terminate accounts that breach these terms or put the service or others at risk. When an account ends, embeds stop working. You can export your contacts before closing.

Disclaimers

The service is provided “as is”. To the extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement.

Limitation of liability

To the extent the law allows, we won’t be liable for indirect, incidental, special, consequential or punitive damages, or lost profits or data. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

Indemnity

You’ll defend and indemnify us against third-party claims arising from your content, your leads, your websites or your breach of these terms.

Governing law

These terms are governed by the laws of the United States and the state specified in your order form or, if none, the state where CalcFunnel’s operating entity is organized, without regard to conflict-of-law rules.

Changes

We’ll post updated terms here and revise the date above. Continued use after changes take effect means you accept them.
